Terms of service

The agreement
These terms are between you and VMGM Software LLC, which operates feedbackskill.dev. By creating an account, installing the SDK or using the service you agree to them. If you are agreeing on behalf of a company, you confirm you can bind it.
What the service does
feedbackskill.dev gives you a card to put in your product. When one of your users presses it, a voice agent asks them what they want, and you get the transcript, in the dashboard or through an AI assistant connected over MCP. What the agent asks at each placement is yours to set.
You need an account and, past the trial, an active plan. You are responsible for keeping your login secure and for what happens under it, including what any member of your organization does.
Recording people is your responsibility
The card records and transcribes the people who use it. It tells them so, and it will not start until they press the button, which is the consent it relies on. You must not remove, hide or reword that notice into something that is no longer a notice.
That is the floor, not the whole of it. You decide where the card goes and what the agent asks, so you are responsible for making sure recording those people, in that place, with that brief, is lawful where they are. That includes any additional notice, consent or policy your jurisdiction or theirs requires, and includes not placing the card where it would record children.
Do not brief the agent to ask for passwords, payment details, health information or anything else you have no business collecting by voice. If a visitor volunteers something like that, treat the transcript accordingly.
Your data stays yours
You keep every right you have in your briefs and in the transcripts your placements produce. You grant us only the permission needed to run the service: to store them, process them, and show them to you and to the assistants you connect. That permission ends when you delete them or close your account.
The voice model is not ours
The conversation is run by a model from xAI. A visitor’s voice goes from their browser to xAI directly, under xAI’s terms and privacy policy, which using this service does not change. We are not affiliated with or acting for xAI. They can change their models, their limits or their policies at any time, and a change on their side may alter what the agent says or break part of what the card can do.
The agent is a language model. It can misunderstand, mishear, or say something you did not brief it to say. Transcripts are what the model heard, not a verbatim record, and you should not rely on one as if it were.
What you may not do
- Record people without a lawful basis, or in a place or a way that is deceptive.
- Use a client id on a site you do not own or are not authorised to put it on, or share one to let somebody else spend your minutes.
- Extract the token the card uses to reach the voice model and use it for anything other than the card.
- Brief the agent to harass, deceive or manipulate the people it talks to, or to collect data you may not collect.
- Attempt to breach, overload or reverse engineer the service, or access another customer’s data.
- Resell access without a written agreement with us.
We may suspend or close an account that does these things, and will say why where we are able to.
AI assistants acting for you
When you connect an assistant, actions it takes with your approved tools are treated as yours. Some of those tools write: they can create a project, change which sites may use it, or rewrite what the agent says to every future visitor at a placement. An assistant can misunderstand an instruction, so review what it is set up to do.
To end a connection, disconnect feedbackskill.dev in the assistant itself, or email us and we will revoke the token.
Billing and minutes
The service is metered in minutes of conversation. A plan is billed in advance through Stripe, renews automatically until cancelled, and includes an allowance of minutes that resets each period. You can also buy packs of minutes, which do not expire, but a plan is what spends them. The trial is a one-time allowance per organization and needs no card.
A minute is counted from the time the card connects until the conversation ends, as measured by our servers. Sessions are capped at five minutes each. When an organization has no minutes left the card stops offering itself until it does.
Cancel any time from your dashboard. You keep access until the end of the period you have paid for, and minutes you have bought wait for you if you come back. Payments are non-refundable except where the law requires otherwise, or where we have clearly failed to deliver the service. If prices change we will give you notice before the change applies to your renewal.
Availability
We work to keep the service running and will not promise it never fails. A conversation depends on a model we do not run and on a browser we do not control, and it can fail because of an outage on either side, a denied microphone, or a network that drops. Offering the card is not a guarantee a conversation will happen.
The service is provided as is, without warranties of any kind to the extent the law allows.
Liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost business, or for claims arising from your decision to record the people you recorded. Our total liability for any claim is limited to what you paid us in the twelve months before it arose.
You will cover us for claims brought by a visitor or a regulator that arise from where you placed the card or what you briefed it to ask, to the extent those were your decisions and not our fault.
Nothing here excludes liability that cannot legally be excluded.
Ending it
You can cancel your plan from your dashboard at any time, and close your account by emailing us. We can suspend or end an account that breaches these terms, or with reasonable notice if we stop offering the service, in which case we will refund the unused part of anything you have prepaid.
Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules, and the courts of Travis County, Texas have exclusive jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country you live in.
The rest
The SDK is published under the MIT licence, and that licence governs the code itself. These terms govern the service it talks to. If any part of these terms is unenforceable, the rest still stands and that part applies as far as the law allows. Not enforcing something once does not waive it. These terms, with the privacy policy, are the whole agreement between us about the service. You may not transfer your rights under them without our consent; we may transfer ours to a successor if the business is sold or merged.
Changes
We may update these terms. The date at the top changes when we do, and for material changes we will tell you before they take effect. Continuing to use the service after that means you accept them.
